These Terms of Service (the "Terms") set out the conditions for using the hosting service provided by ASHIKA Network (the "Service") and the agreement between you and the Service. By applying for the Service, you are deemed to have agreed to these Terms.
Chapter 1: General provisions
Article 1 (Definitions)
- "The Service" means the hosting service provided under the name ASHIKA Network, and all of its features, including this website and the customer panel.
- "You" or "customer" means a person who has registered an account with the Service, or who is about to register.
- "Subscriber" means a customer who is provided with a server, whether paid or free of charge.
- "Registered information" means the information provided by a customer to register and use an account.
- "Stored data" means the files and database contents that a subscriber has placed, generated or stored on a server.
- "Individual provisions" means the Acceptable Use Policy (AUP) and any other rules the Service sets separately from these Terms.
Article 2 (Application of the Terms and individual provisions)
- These Terms apply to all matters relating to the use of the Service.
- Individual provisions, whatever their name, form part of these Terms.
- If these Terms and individual provisions conflict, the individual provisions prevail unless they provide otherwise.
Article 3 (What we provide)
- For people who need servers or runtime environments for development, learning, running communities and similar purposes, the Service provides:
- Rental of virtual servers (VPS)
- Runtime environments for programs, including Python
- Rental of subdomains
- Anything else the Service states it provides on this website or in the customer panel
- The specifications and prices of the plans are as posted in the customer panel and on this website.
- The Service can be used by people living either in or outside Japan. This website is provided in Japanese and English, but the English pages are reference translations. The customer panel and inquiries are handled in Japanese.
Chapter 2: Accounts
Article 4 (Registering an account)
- If you wish to register an account, please agree to these Terms and register the information the Service requests. The contract under these Terms is formed when registration is complete.
- By agreeing to these Terms, you are deemed to have agreed to each of their articles.
- The Service may refuse registration or re-registration in any of the following cases, and is not obliged to explain the reason:
- All or part of the registered information is untrue
- Your account has previously been suspended for violating these Terms or individual provisions
- You already have another account
- The account is expected to be used by someone other than the registrant, for example for resale or transfer
- The Service judges that you run, or are involved in running, a service similar to or competing with the Service
- You do not respond to identity verification separately requested by the Service, or the Service judges that your identity cannot be verified
- Registration was made by an automated program or other improper means, or the Service judges that the registration was not made by a person
- A minor tries to register without the consent of a parent or other legal guardian
- You do not agree to these Terms
- Any other case in which the Service judges it inappropriate to allow registration
Article 5 (Managing your account)
- You must manage your account on your own responsibility. You may not let third parties use it, or lend, transfer, rename or sell it.
- All operations performed with an account are treated as performed by the customer of that account.
- The Service is not liable for damage caused by a third party using your account, for example because it was not managed well enough or an easily guessed password was set, except where the Service acted with intent or gross negligence.
- Unless the Service can confirm that an operation was performed by a third party, it may treat it as performed by you.
Chapter 3: Fees and payment
Article 6 (Fees)
- Subscribers must pay the fees shown in the customer panel by the methods shown there.
- "One month" in contract periods means 30 days.
- Even if a contract is terminated or cancelled, fees are not prorated or refunded. Subscribers must pay the fees for the full contract period, whatever the date of termination or cancellation.
- If a subscriber fails to pay, the Service may claim late payment damages at a rate of 14.6% per year on the amount due.
Article 7 (Cancellation)
- Subscribers can cancel their servers themselves at any time from the customer panel.
- Even if you cancel partway through the contract period, you can keep using the server until the remaining period ends.
Article 8 (Refunds)
- For cancellations for the subscriber's own reasons or other reasons on the customer's side, there are no refunds and no proration.
- If provision of the Service stops without notice for reasons on the Service's side, the Service may extend the contract period or give a refund according to the length of the outage. Outages for maintenance or similar work announced in advance do not count.
Chapter 4: Using the Service
Article 9 (Prohibited acts)
In using the Service, you must not do any of the following. Whether something falls under these is decided by the Service. Prohibited acts are also detailed in the Acceptable Use Policy (AUP); please read it as well.
- Acts that violate laws and regulations, or acts related to crime
- Fraud or threats against the Service, other customers or other third parties
- Acts contrary to public order and morals
- Acts that infringe the copyrights, trademarks or other intellectual property rights of the Service or third parties
- Impersonating a third party, or registering untrue information
- Letting a third party log in to your account
- Creating or distributing computer viruses, unauthorized access, DDoS attacks, or other acts that disrupt third-party systems
- Using the Service's servers to harm the Service, or as a stepping stone for attacks on third parties
- Sending spam, or operations that breed it
- Sending or storing child pornography or content depicting child abuse
- Placing extremely large amounts of data, using the Service as file storage
- Making content contrary to public order and morals, such as excessively violent or sexual expression, viewable by third parties
- Reselling the Service, or letting third parties use it, without the Service's consent
- Placing a heavy load on other customers or on the Service's network or servers
- Analyzing the Service's configuration or source code
- Unauthorized access, or attempts at it, to the Service's network or systems
- Providing benefits to, or otherwise cooperating with, antisocial forces
- Any other act the Service judges inappropriate
Article 10 (Shared resources)
- The Service's servers share resources such as CPU, memory, disk and network among multiple subscribers.
- If usage stays close to the limits of your plan, the Service may temporarily stop your server without notice.
- If usage repeatedly exceeds the limits, the Service may restrict the use of your server.
Article 11 (Stored data)
- Subscribers are responsible for managing their own stored data.
- The Service does not guarantee the preservation of stored data. Always keep your own backups of important data.
- The Service is not liable for any loss or corruption of stored data.
Chapter 5: Suspension, termination and violations
Article 12 (Suspension of the Service)
- The Service may stop or interrupt all or part of the Service without notice in any of the following cases:
- System inspection or maintenance must be done urgently
- A matter affecting customers' safety arises, such as the discovery of a serious vulnerability
- Equipment or communication lines stop due to an accident
- Operation becomes impossible due to force majeure, such as earthquakes, lightning, fire, storms and floods, power outages or epidemics
- Any other case in which the Service judges stopping or interruption necessary
- The Service is not liable for damage caused by measures under this article.
Article 13 (Suspension of accounts and servers)
- If you violate Article 9 (Prohibited acts) or individual provisions, or if it turns out that a reason for refusing registration under Article 4, Paragraph 3 applies, the Service may suspend or delete your account.
- In that case, servers under contract may also be stopped or deleted.
- There are no refunds, extensions of the contract period, or returns of stored data in connection with these measures.
- If the Service judges a violation to be malicious, it may report it to the relevant authorities and claim damages.
Article 14 (Changes to and termination of the Service)
- The Service may change what it provides, or stop providing it, at its own discretion.
- If the Service ends, customers will be notified at least one month before the planned end date.
- The Service is not liable for damage caused by measures under this article.
Article 15 (Objections)
- If you disagree with a decision or measure taken by the Service, you may file an objection.
- Objections must be made through the contact methods in Article 18.
- Objections can be filed within 30 days from the date the Service made the decision or took the measure.
- When filing an objection, please attach one identity document (My Number Card (do not attach the back side), driver's license, passport or health insurance card).
- The Service's decision on the objection will be sent to the address shown on the identity document.
Chapter 6: Disclaimers
Article 16 (Disclaimers)
- If the Service cannot be provided for reasons not attributable to the Service, such as natural disasters, epidemics, war, riots, civil unrest, fire, floods, the enactment, amendment or repeal of laws, intervention by public authorities, labor disputes or accidents involving transport, the Service bears no liability for damages or otherwise.
- The preceding paragraph does not apply where the Service acted with intent or gross negligence.
Article 17 (Ownership of rights)
- Copyrights and other intellectual property rights in the Service and this website belong to the Service or to those who license their use to the Service. Using the Service does not transfer these rights to you.
- You warrant to the Service that you have the legitimate right to use the data you use or upload on the Service.
Chapter 7: Miscellaneous
Article 18 (Inquiries and communication)
- Communication between you and the Service takes place through the customer panel, email or the official Discord server.
- Unless you notify us otherwise, the Service treats your registered contact details as valid and treats a message as having reached you at the time it is sent to them.

Article 19 (Personal information)
- The Service handles the personal information entrusted to it by customers in accordance with the separately established Privacy Policy.
- The Privacy Policy can be found at the bottom of this website.
Article 20 (Changes to the Terms)
- The Service may change these Terms when it judges it necessary.
- The changed Terms take effect when they are posted on this website.
Article 21 (Governing law and jurisdiction)
- These Terms and the contract for use of the Service are governed by the laws of Japan.
- Any dispute relating to the Service is subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.
Supplementary provisions
- These Terms take effect on July 21, 2026.
- The amendment to Article 3, Paragraph 3 takes effect on October 7, 2026.
